Board moves to hold Juilfs at fault
POMEROY – The former administrator of the Pomeroy Care Center is facing licensing penalties related to a 2011 incident when the facility housed a registered sex offender.
A notice of hearing from the Iowa Board of Nursing Home Administrators alleges that Susan Juilfs, former administrator at the Pomeroy Care Center, is guilty of professional incompetence.
The statement, filed June 11, alleges that Juilfs should have known that William Cubbage, a resident of the facility from 2010-2011, was “a threat to other residents” and that she “failed to ensure that all residents were protected from the known threat posed by the male resident.”
Cubbage was convicted of sex crimes in 1987, 1991, 1997 and 2000. He lived in the Iowa Civil Commitment Unit for Sex Offenders in Cherokee from 2002 until November 2010 when he was court-ordered to move to the nursing home because of his health after not being declared a threat by the state.
An Iowa Department of Inspections and Appeals report stated that Cubbage had chronic airway obstruction and that he is borderline intellectual functioning with an IQ of 81.
The Pomeroy facility was under investigation by the IDIA for an incident involving staff members, allegations of abuse and a resident who was a known registered sex offender, according to an October 2011 Messenger story. Three individuals employed by the care center were let go at that time, however, it was unclear if the firings were related to the investigation.
The facility had been fined $10,000 by the IDIA for failure to properly supervise some of its residents, The Messenger reported on Nov. 10, 2011. According to the investigation report the facility “failed to provide adequate supervision to five of five” residents reviewed for supervision concerns.”
The report also stated that on Aug. 21, 2011, a child visitor at the facility witnessed a resident, later identified as Cubbage, touching a female resident between the legs and that he would often target another female resident whom he frequently attempted to take to the restroom.
Cubbage was removed from the Pomeroy Care Center in November 2011, The Messenger reported Nov. 22, 2011. At that time, he was moved to the Newton Correctional Facility pending a trial to determine if he should be committed to a locked unit for sex offenders.
The Iowa Sex Offender Registry lists Cubbage as a current inmate at the Iowa Medical and Classification Center in Oakdale.
Pomeroy Care Center staff said Wednesday that Juilfs was employed at the facility until October 2011. She is presently the administrator at the Lakeside Lutheran Home in Emmetsburg.
A board hearing for Juilfs has been scheduled for Oct. 24.
Attempts to reach Juilfs Wednesday were unsuccessful. A call to the Iowa Board of Nursing Home Administrators was not returned.
