Levin charged with murder in mother’s death
EARLY – A man originally charged with kidnapping and assault is now facing murder charges in the death of his mother.
Kirk Levin, 21, of Early, was charged with first-degree murder on Monday, four days after his mother’s body was discovered in her home at 2242 Ira Ave. in Early.
Sac County Sheriff Ken McClure said an autopsy conducted on Marilyn Schmitt, 45, found that she “died of sharp force injuries.”
According to the criminal complaint, Levin stabbed his mother between 1:30 to 5:45 a.m. on Jan. 3 in an upstairs bedroom.
“Kirk Levin admits to law enforcement that he was the only one who could have killed the victim,” the complaint stated. “Kirk Levin admitted that he choked his mother and that he had to have her killed.”
Levin had just been released from prison on burglary charges two days before he allegedly killed Schmitt.
The same day Schmitt’s body was found, Levin was also charged with kidnapping and assaulting a 21-year-old woman from Storm Lake.
McClure said Levin showed up at the woman’s house and asked for a ride. Levin allegedly held the woman against her will and told her she was being kidnapped.
Levin allegedly took the woman to the farmhouse where his mother lived and tied her up with a rope. McClure said at one point Levin put the woman in the trunk of his car, then put her in the back seat.
The woman was able to escape and got the attention of a bystander, who called 911.
Investigators discovered Schmitt’s body while investigating the kidnapping, according to McClure.
Levin is charged with assault with intent to commit sexual abuse, assault while participating in a felony and third-degree kidnapping in that case.
He is being held in the Sac County Jail on $200,000 bond.
Sac County Attorney Ben Smith said Levin’s bond review, as well as his initial appearance on the murder charge, will be held at 11 a.m. today.
Mass of Christian Burial for Marilyn Schmitt will be held at 10:30 a.m. Thursday at the Sacred Heart Catholic Church in Early. Visitation will be held from 5 to 8 p.m. Wednesday at the church. Farber and Otteman Funeral Home in Early is in charge of arrangements.
